Gordon Jenkins' DWI trial set for September 8

SOUTH FALLSBURG — Monticello Mayor Gordon Jenkins' DWI trial now has a start date, according to a Fallsburg judge.

Called before Town Judge Ivan Kalter Wednesday evening at a scheduled court appearance, Jenkins' attorney, Michael Sussman, quickly requested, and was granted, an 8 p.m. conference.

Following the brief meeting, held in the judge's chambers, Kalter settled on September 8 as the start date for Jenkins' jury trial stemming from his now infamous November, 2013 arrest in the Village of Monticello for suspicion of DWI shortly after arriving at the scene of two-car motor vehicle accident on Broadway in the village.

Jenkins had been at a neighbor's party when he caught wind of the crack-up, promptly driving himself to the scene, to, as he told the Democrat days after the arrest “see if I could help out.”

Fire personnel on the scene noticed the mayor was “out of sorts” and alerted police. Upon leaving the accident scene Jenkins was pulled over for unreasonable speed and failure to keep right, leading to the misdemeanor DWI rap.

Once in police custody, Jenkins garnered two additional charges of obstructing governmental administration, stemming from his refusal to comply with the arrest process - Jenkins refused a chemical test; and criminal mischief, stemming from Jenkins allegedly damaging police department property while in custody (Jenkins reportedly broke a wall clock at the village police department while being booked).

After nearly seven hours in police custody - all of which was famously captured on police surveillance video, and posted, just days later, on popular video sharing site YouTube by Village Trustee and longtime Jenkins adversary, Carmen Rue - Jenkins would complain of chest pains.

Jenkins would subsequently be taken to Catskill Regional Medical Center where he would undergo blood tests. The tests would later be released to law enforcement as a result of the Monticello Police Department's application for a search warrant to obtain the test results.

Police officials claim the tests revealed the two term mayor's blood-alcohol content to be 0.13, exceeding New York's 0.08 legal limit.

Kalter expects the case to stretch no more than three days and further ordered the matter take place during daylight hours.

Jenkins offered no comment Wednesday evening.
