Garnet Health reaches proposed settlement

Patients with MyChart accounts between 2020 and 2023 may be eligible

REGION – Patients in Sullivan County and across the region who used Garnet Health’s MyChart patient portal between May 7, 2020, and August 10, 2023, are being notified of a proposed federal class-action settlement tied to allegations that patient information was shared with third parties through online tracking technologies.

The case does not involve a cyberattack, ransomware incident, or theft of medical records. Instead, it centers on claims that third-party tracking technologies associated with Garnet Health’s MyChart patient portal transmitted patient-related information to outside companies without consent.

The lawsuit, Gay et al. v. Garnet Health, was filed in 2023 in the U.S. District Court for the Southern District of New York. Plaintiffs alleged that tracking tools such as Meta Pixel and Google Analytics were used in connection with MyChart in a way that violated certain privacy laws by allowing patient-related data to be shared with outside companies.

In court documents, Garnet Health denied the allegations and has not admitted wrongdoing. In 2024, a federal judge allowed several privacy-related claims in the case to proceed past an early motion to dismiss. Rather than continue litigation into full discovery, the parties later reached a proposed settlement.

Representatives of Garnet Health did not respond for comment by presstime yesterday afternoon.

According to Kroll Settlement Administration LLC, the court-appointed settlement administrator, the court has defined the settlement class as all natural persons who were patients of Garnet Health between May 7, 2020, and Aug. 10, 2023, and who had a MyChart account with a status of “Alive” during that period.

Eligible class members may be entitled to a one-time cash payment of $19.50 and one year of Dashlane Premium privacy-monitoring services, pending final court approval. Eligibility does not depend on demonstrating financial loss, identity theft, or misuse of personal information.

A final approval hearing is scheduled for April 13, 2026. Claims for benefits must be submitted by April 16, 2026, while deadlines to opt out of the settlement or submit objections fall on March 17, 2026. If the settlement is approved, claims will be processed and benefits distributed afterward.

Claims are administered through a court-authorized settlement website, where eligible individuals may submit a claim online or by mail. No medical records or documentation of harm are required.

Court filings state the settlement would resolve the case without a trial or ruling on the merits. Garnet Health maintains that it acted appropriately and agreed to the settlement to avoid continued litigation.
