To the editor:
Your article entitled "Forestburgh ZBA denies Lost Lakes permit appeal" on December 10, 2022 is factually incorrect when it states that
"The denied building permits now disallow any further housing development to be constructed within the Lost Lakes Holdings LLC property."
Please note that there is no prohibition on continuing with the housing development at Lost Lake as long as the developer complies with the original approval and design conditions as filed with the Clerk of the County, County of Sullivan, NY.
The issue at hand was that the developer submitted applications for building permits that were substantially different from the original approval and design conditions while the developer of Lost Lake claimed that the Town building inspector had no authority to deny the building permits and that the developer himself in his sole discretion had the authority to change the design conditions as he sees fit.
In this, the developer is wrong and the Town is in the right.
