WOODBOURNE — Months after a court settlement barred use of the Rose Road property in Fallsburg for anything other than agriculture, neighbors say the activity continues—and now, town officials confirm legal action may be underway.

At the August 26 Fallsburg Town Board meeting, a resident raised concerns during public comment about the property at 63–73 Rose Road, owned by YNHK LLC. They questioned why the town hasn’t enforced the court-ordered agreement, noting that work crews, livestock, and apparent residential occupancy continue at the site.

Before Town Supervisor Michael Bensimon could respond, Town Attorney Richard Baum stepped in and stated: “An order to show cause has been issued.”

Baum offered no further details at the meeting, and as of presstime, the town has not provided clarification on when the order was filed or whether it has been served to YNHK LLC.

The property, formerly a horse farm, has been the subject of ongoing legal and zoning battles since 2023, when the town discovered that YNHK had converted a barn into a dormitory and constructed three additional buildings without permits. Under a court-approved settlement signed in May 2024, YNHK agreed not to use or occupy the property until it received site plan approvals, special permits, building permits, and certificates of occupancy.

Despite that agreement, neighbors report the property is still being used as a residential camp, with new fencing, active construction, and livestock present. The town has not confirmed whether building or code enforcement has visited the property in recent weeks.

Attorney Jonathan Kroll, who has represented YNHK LLC, previously stated that the property is being operated as a farm, consistent with its zoning. “We remain fully committed to following all local codes and regulations,” he wrote in an earlier statement. 

Kroll did not return a request for comment on the reported order to show cause by presstime.
