Devany Road’s municipal water, sewer agreement expected

LIBERTY — An inter-agency agreement is expected to be presented before the Town Board following a 3-1 vote in favor of pursuing a resolution, which if adopted would allow municipal water on Devany Road for the 10 existing properties as out-of-district users and sewer for the nine that are in the district for one year.

Those who voted yes were Supervisor Frank DeMayo and board members Dean Farrand and John Lennon Jr. Voting no was board member Sherri Kavleski. Absent from the meeting was board member Vincent McPhillips.

The Supervisor noted that after extensive conversation between the town’s consultant, Delaware Engineering, and the builder Abraham Mizrahi’s consultants, Delta Engineering, as well as other interested parties, it was estimated that the request would total roughly 14,000 gallons per day for the 10 units.

He also spoke on his recommendations moving forward.

“They would need engineer drawings approved by the town engineer and water and sewer department. The construction for the distribution system would be by the builder, they would bear the cost,” DeMayo said. “Any necessary regulatory agency requirements must be secured, and I would also recommend an escrow of $5,000 for review and town costs.”

Town Board member Dean Farrand confirmed with the town’s legal counsel, Ken Klein, that it is “last in, first out” for out-of-district users, should capacity be reached.
